Acceptable Use Policy (AUP)

5G Internet Services
Governing Law: State of Florida

1. Purpose and Scope

Symmetry IT Consultants, INC (“Symmetry,” “we,” “us,” or “our”) provides commercial 5G Internet and related services (“Service”) to business customers. This Acceptable Use Policy (“Policy”) defines permitted and prohibited uses of the Service to ensure lawful operation, network integrity, and fair access for all customers.

This Policy is incorporated by reference into and forms part of Symmetry’s Service Order Agreements, Terms and Conditions, and any related agreements (collectively, the “Business Services Agreement”). Capitalized terms not defined herein have the meanings assigned in the Business Services Agreement.

2. Applicability and Acceptance

This Policy applies to:

  • All Symmetry customers, and

  • Any individual or entity that accesses or uses the Service through a customer account, including employees, contractors, guests, and third parties.

By using the Service, you agree to comply with this Policy. Failure to comply may result in suspension, limitation, or termination of Service, and may give rise to additional charges or legal remedies as permitted by law.

If you do not agree to this Policy, you must immediately discontinue use of the Service and notify Symmetry.

3. Policy Modifications and Notices

Symmetry may modify this Policy at any time by posting an updated version on its website or by providing notice through reasonable commercial means. Modifications are effective immediately upon posting.

Continued use of the Service after changes constitutes acceptance of the revised Policy.

4. Prohibited Uses and Activities

Use of the Service must comply with all applicable laws, including Florida law, United States federal law, and applicable local ordinances. Prohibited activities include, but are not limited to, using the Service to:

A. Unlawful Conduct

  • Engage in any activity that violates federal law, the laws of the State of Florida, or applicable local laws or regulations

  • Transmit, store, or distribute material that is unlawful, defamatory, obscene, threatening, abusive, or fraudulent

  • Infringe or misappropriate intellectual property rights, including copyrights, trademarks, trade secrets, or proprietary information

  • Engage in identity theft, impersonation, phishing, or other deceptive or fraudulent practices

B. Messaging and Communications Abuse

  • Send unsolicited bulk messages, spam, or mass commercial communications

  • Harvest or collect personal information or identifiers without lawful authority or consent

  • Falsify message headers, sender information, or routing data

  • Use bots, scripts, or automated systems to generate excessive or deceptive communications

C. Security Violations

  • Access or attempt to access systems, networks, devices, or data without authorization

  • Circumvent authentication, encryption, or security safeguards

  • Introduce malware, spyware, ransomware, viruses, or similar harmful code

  • Conduct denial-of-service attacks, port scanning, or network probing without authorization

D. Network and Service Abuse

  • Interfere with, disrupt, or degrade the Service, Symmetry’s network, or the use of the Service by others

  • Generate traffic that is excessive, abnormal, or inconsistent with typical business use

  • Use the Service to operate as an Internet service provider or resell bandwidth without Symmetry’s prior written consent

  • Connect Symmetry-provided equipment outside the authorized service location

5. Customer Responsibilities

Customers are solely responsible for:

  • All activity conducted through their Service account

  • Preventing unauthorized use of the Service

  • Securing customer-owned equipment and networks

  • Compliance with applicable copyright laws, including the Digital Millennium Copyright Act (17 U.S.C. § 512)

  • Promptly addressing misuse or violations associated with their account

Customers agree to indemnify and hold harmless Symmetry from claims arising out of their violation of this Policy or applicable law.

6. Content and Network Management

Symmetry reserves the right, but not the obligation, to:

  • Monitor Service usage for compliance and security purposes

  • Restrict, block, or remove content or traffic that violates this Policy or threatens network integrity

  • Cooperate with law enforcement or regulatory authorities as required by law

Symmetry is not responsible for delays, deletion, misdelivery, or failure to store data or communications transmitted over the Service.

7. Network Management Practices

Symmetry employs reasonable and commercially accepted network management practices consistent with industry standards to:

  • Protect network security and reliability

  • Mitigate spam, malware, and malicious activity

  • Ensure fair allocation of network resources

Network management practices may evolve as technology and threats change.

8. Data Usage and Commercial Use

The Service is intended for commercial business use only. Symmetry reserves the right to investigate and take action if usage:

  • Is excessive or inconsistent with normal business operations

  • Creates an unreasonable burden on the network

  • Interferes with Symmetry’s ability to provide services to others

Symmetry’s determination regarding improper or excessive use shall be final.

9. Enforcement and Remedies

If Symmetry determines, in its sole discretion, that this Policy has been violated, Symmetry may:

  • Suspend, limit, or terminate the Service immediately, with or without notice

  • Remove or block offending traffic or content

  • Pursue contractual, legal, or equitable remedies as permitted under Florida law

Failure to enforce any provision of this Policy does not constitute a waiver of Symmetry’s rights.

10. Governing Law and Venue

This Policy and any disputes arising from or related to it shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict-of-law principles. Venue shall lie exclusively in the state or federal courts located in Florida, unless otherwise required by law.
